1. Purpose


These general conditions of sale (hereinafter the "General Conditions of Sale") apply to the sales made by the company Atlasformen, Société par actions simplifiée (SAS), registered in the RCS de Paris under number 449 149 038, whose head office is located 87-89 rue La Boétie - 75008 Paris - France, (herein) (hereinafter "Atlasformen") and any individual (hereinafter the "Customer") having the legal age of majority in his province of residence, who is not prohibited from using websites and who is able to enter into a binding legal agreement under the applicable legislation.

These General Conditions apply to an order made by telephone, mail or via the website https://www.atlasformen.ca (hereinafter the "Site") by a Customer located in Canada.

Any placing of an order is deemed to be acceptance of the prices and General Conditions of Sale as they are in effect at the time of formation of the contract (i.e. at the time of the order by the Customer).

Atlas For Men remains free at any time to add to, modify, correct or delete all or part of the General Conditions of Sale upon 30 days’ prior written notice prior to the coming into force of the modification.


2. Essential Product Features - Validity of Offers


The products offered for sale are described in the product descriptions found on each item tag.

Photographs present an overall view of each article, some colour alterations may appear due to computer media. The proposed sizes are clearly listed. A size guide is available on the Site as well as in our catalogues.

The expected length of time Atlasformen should be able to provide the Customer with the replacement parts necessary for the use of the products covered by the order depends on the availability of the parts from the various Atlasformen suppliers and the information provided by these suppliers to Atlasformen. When this information is available, Atlasformen will inform the Customer (in the product description)

In the event of immediate unavailability of items or stock shortage despite Atlasformen’s efforts, the Customer will be informed as soon as possible.

In the event of a stock shortage making the ordered product unavailable, upon acceptance by the Customer, Atlasformen may offer to replace the ordered product with an item with characteristics similar to that initially ordered by the Customer.


3. Order Validation


Orders are placed by the Customer either by telephone, by mail or on the Site. Offers are valid as long as they are visible on the Site, or for the duration indicated in any commercial documents.

For telephone orders: The contract is entered into between Atlasformen and the Customer at the time the order is validated by the Customer Service Member Operator of Atlasformen.

The contract shall be deemed to have been entered into at the address of the Customer.

For mail orders: The contract is entered into between Atlasformen and the Customer at the time a purchase order is sent by the Customer to Atlasformen.

The contract shall be deemed to have been entered into at the address of the Customer.

For orders on the Site: The contract is entered into between Atlasformen and the Customer at the time the Customer clicks on the order button, after checking the contents of the basket and the total price of the order and after having read and accepted the General Conditions of Sale brought to his knowledge by means of a link on the basket validation page, which he attests by checking the box "By checking this box, I accept and acknowledge having read the General Conditions of Sale of Atlasformen" on the basket validation form.

The contract shall be deemed to have been entered into at the address of the Customer.

For all the orders, the Customer will receive an email confirming the registration of its order. Processing and shipping will then be done.


4. Price - Payment


Product prices are as indicated:

• On commercial documents;
• On the Site at the time of order.

Prices shown on the Site and in the commercial documents do not include taxes and delivery charges, and are in Canadian dollars, except as indicated in any purchase order, on the Site and on any invoice issued to the Customer. The delivery charges charged to the Customer are indicated on the purchase orders and on the Site.

Prices on products sold are subject to change. The dates and conditions of the offers offered to Customers are clearly stated on the Site and on the commercial documents addressed to Customers. These offers are also valid subject to the availability of the items. Certain promotions/discounts offered on the Site and/or in our commercial documents are only valid if the amount of the purchase before taxes exceeds the conditions set forth on the Site and on the sales documents addressed to the Customers.

Delivery options and associated costs are as follows:

• The cost of home delivery for the Customer is $9.
• The terms of payment proposed to the Customer are indicated on the purchase orders and on the Site
• The order must be paid by credit card (Visa, Mastercard) or Paypal.

In the event of payment by credit card, the Customer shall provide the 16 digits present on the card, the expiry date and the 3 digits present on the back of the card near the signature (cryptogram). The Site uses a Secure Socket Layer (SSL) secure payment method. Banking data is encrypted and does not circulate in plain form on the Internet.

In case of orders made by mail, in the event of delay or failure to pay, the late charges indicated on the invoice issued to the Customer may be applicable.


5. Delivery



The products are delivered exclusively in Canada.

Delivery price offers (e.g.: delivery offered for $60 in purchases) are valid only in Canada.

Parcels are delivered via network Landmark Global / Poste Canada / intelcom for shipments.

The delivery times indicated on the Site and any commercial documents represent the usual average time for processing the order, shipping and delivery and are provided for information purposes only. For orders placed on the Site, the maximum delivery time is 10 days from the receipt of the order by Atlasformen. For orders placed by mail, the maximum delivery time is 15 days from the receipt of the order by Atlasformen.

Delivery shall be deemed to have been made as soon as the product is delivered to the Customer by the carrier at the address indicated by the Customer.

Delivery is deemed to be made upon the delivery of the product to the Customer by the carrier at the address specified by the Customer.

6. Exchange or Return Policy


Atlasformen allows the Customer to return the ordered items within sixty (60) days of receipt.

If an item is not suitable, the Customer must return the return voucher addressed with the invoice accompanying the package. If an item is not suitable, the Customer may exchange it or obtain a refund. Any return fees and costs are at the expense of the Customer.

Damaged or incomplete items will not be accepted. No return or exchange will be accepted for goods damaged by normal wear and tear of the goods or in the event of misuse or poor maintenance of the Customer.

The Customer can return the products to Atlasformen at the address listed below:

Atlasformen at Bollore Logistics Canada, 3400 Douglas Street B Floreani, Saint-Laurent, Québec, H4S 1V2, Canada.

Products must be returned in their original condition and packaging, as delivered to the Customer, and must not show any signs of disassembly, installation or use.

Atlasformen will reimburse the cost of return on request, only in the event of proof of a defective item or shipping error attributable to Atlasformen.

The refund or exchange will be made within 30 days of receiving the return package.


7. Liability and Termination


The Customer understands that despite all the care taken in the creation and updating of the Site, errors, inaccuracies or omissions may persist as well as problems of connection to the Site or interruption in connection.

For customers who have placed an order by telephone, you may cancel the sale without charge or penalty, for any reason, within 7 days of receiving the agreement. In such a case, all reasonable costs of restitution of the goods forming the object of the contract shall be assumed by Atlasformen.


8. Intellectual Property



The contents of the catalogues and commercial documents addressed to the Customer by Atlasformen, the Site and all the elements constituting it, including the various contents (software, hardware, formats, interfaces, slogans, data, text, tables, images, videos, logos, symbols, audio content, computer codes, information, design, arrangement, etc.), as well as all trademarks, product names, reasons, social and logos or any other intellectual property listed belong to Atlasformen and/or its partners/providers and are protected by intellectual property rights reserved for the sole holders of those rights.

It is strictly forbidden to use, in any way whatsoever, including reproducing, printing, archiving, rewriting, modifying, uploading, downloading, selling or otherwise copying, for any reason whatsoever, the content of the Site or any commercial media and documents of Intellectual Property, in whole or in part, in any medium or in any format whatsoever, invented or to be invented, without the express, written and prior consent of the Atlasformen.


9. Personal Information


To order products on our Site or through purchase orders or to create an online account, the Customer must provide certain personal information necessary to open an account or for Atlasformen to process the order.

The personal information provided by the Customer is collected, used and processed in accordance with the Privacy Policy of Atlasformen.

10. Governing Laws


These General Conditions of Sale and all transactions contemplated therein are governed by the laws of Québec and applicable federal laws.
